What is Wage Garnishment?
If you owe money to the IRS, they can legally take collection actions against you. This includes, but is not limited to, garnishing your wages.
When the IRS moves to garnish a person’s wages, the agency contacts the taxpayer and the taxpayer’s employer, notifying both that garnishments will begin in 30 days. If the taxpayer hasn’t paid off their back taxes in full or taken steps to set up a payment plan with the IRS by the end of the 30-day period, the IRS will order the employer to begin sending a portion of the employee’s paycheck directly to the IRS.
Unlike private creditors, the IRS doesn’t have to take you to court and win a court-ordered judgment to legally garnish your wages. And the IRS is afforded wide discretion in determining the amount of money they want garnished. Generally speaking, the IRS can garnish 25% – 50% of a taxpayer’s earnings, depending on the circumstances.
Can You Stop a Garnishment Once It Starts?
Wage garnishments are essentially the IRS’s way to put the taxpayer into an installment plan (albeit, an involuntary one). Once the IRS begins garnishing a person’s wages, there are two primary ways to put a stop to future garnishments going forward.
• The taxpayer (or the taxpayer’s legal representative) works with the IRS to negotiate an alternative payment plan, such as an offer in compromise, a formal installment agreement, etc.
• The taxpayer pays their back taxes in full to IRS.
